These Terms and Conditions ("Terms") govern your use of the website tripcabinet.com ("Website") and the services offered by Tripcabinet Travel Private Limited ("TripCabinet", "we", "our", or "us"), a company incorporated under the laws of India (CIN: U52291KA2023PTC179561), with its registered office at 8th Floor, Regus-The Estate, Dickenson Road, Bangalore, Karnataka 560042, India.

By accessing or using our Website or booking any services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.

1. Definitions

"Customer" / "You" refers to any individual or entity that accesses our Website or books travel services through TripCabinet.
"Services" refers to all travel-related services offered by TripCabinet, including but not limited to tour packages, hotel bookings, transport arrangements, visa assistance, and travel insurance facilitation.
"Booking" refers to a confirmed reservation of any Service made through the Website.
"Supplier" refers to third-party service providers such as airlines, hotels, transport operators, and local tour operators.

2. Eligibility

You must be at least 18 years of age and legally competent to enter into a binding contract under Indian law to use our Services. If you are booking on behalf of others, you confirm that you have the authority to accept these Terms on their behalf.

3. Booking and Confirmation

All bookings are subject to availability and confirmation by TripCabinet.
A booking is confirmed only after we issue a written confirmation (via email or the Website) and receive the required payment or deposit.
Prices quoted are subject to change until a booking is confirmed. TripCabinet reserves the right to correct any pricing errors prior to confirmation.
You are responsible for ensuring that all information provided during booking (names, dates, passport details, etc.) is accurate and complete. TripCabinet shall not be liable for errors caused by incorrect information provided by the Customer.

4. Pricing and Payment

All prices are displayed in Indian Rupees (INR) unless otherwise stated.
Prices include applicable taxes unless explicitly stated otherwise.
Payment must be made as per the payment schedule communicated at the time of booking. Failure to make timely payments may result in cancellation of your booking.
We accept payments via bank transfer, UPI, credit/debit cards, and other methods as displayed on the Website.
TripCabinet reserves the right to revise prices due to currency fluctuations, fuel surcharges, government-imposed taxes, or changes in Supplier pricing. Any such revision will be communicated to you before confirmation.

5. Cancellation and Refund Policy

Cancellation requests must be submitted in writing to [email protected] or through the Website.
Cancellation charges apply based on the number of days prior to the departure date:
- More than 30 days before departure: 25% of the total booking amount
- 15 to 30 days before departure: 50% of the total booking amount
- 7 to 14 days before departure: 75% of the total booking amount
- Less than 7 days before departure or no-show: No refund
Refunds, where applicable, will be processed within 14 business days to the original payment method.
Non-refundable components (such as airline tickets, visa fees, or special event tickets) are excluded from refund calculations.
TripCabinet reserves the right to cancel any booking due to unforeseen circumstances, force majeure, or insufficient participants for group tours. In such cases, a full refund or alternative arrangement will be offered.

6. Travel Documents and Visa

It is the Customer's sole responsibility to ensure valid passports, visas, travel permits, health certificates, and any other documentation required for the trip.
TripCabinet may assist with visa applications as a facilitation service, but we do not guarantee visa approval. Visa rejection shall not entitle the Customer to a refund of non-refundable components.
Passports must be valid for at least 6 months from the date of travel.

7. Travel Insurance

TripCabinet strongly recommends that all Customers purchase comprehensive travel insurance covering trip cancellation, medical emergencies, baggage loss, and personal liability. TripCabinet shall not be liable for any losses or expenses arising from the lack of adequate insurance coverage.

8. Itinerary Changes

While TripCabinet endeavours to operate all tours as advertised, we reserve the right to modify itineraries, accommodations, or transport arrangements due to weather conditions, political situations, Supplier changes, or other factors beyond our control.
In such cases, we will provide suitable alternatives of comparable standard. No refund will be provided for minor itinerary adjustments.
Optional activities or excursions are subject to local availability and weather conditions.

9. Customer Responsibilities

You agree to comply with all local laws, customs regulations, and guidelines of the destinations visited.
You shall behave in a manner that does not endanger the safety or enjoyment of other travellers or service providers.
TripCabinet reserves the right to refuse or terminate service to any Customer whose behaviour is deemed disruptive, dangerous, or unlawful, without any refund.
You are responsible for safeguarding your personal belongings, travel documents, and valuables during the trip.

10. Limitation of Liability

TripCabinet acts as an intermediary between Customers and third-party Suppliers. We shall not be held liable for any injury, loss, damage, delay, or inconvenience caused by the acts, omissions, or negligence of any Supplier, including airlines, hotels, transport operators, or local guides.
TripCabinet shall not be liable for any loss or damage arising from force majeure events, including but not limited to natural disasters, pandemics, war, terrorism, strikes, government actions, or travel advisories.
Our total liability for any claim shall not exceed the total amount paid by the Customer for the specific booking in question.

11. Intellectual Property

All content on the Website, including text, images, graphics, logos, and software, is the property of Tripcabinet Travel Private Limited and is protected under applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

12. Privacy

Your use of our Website and Services is also governed by our Privacy Policy. By using our Services, you consent to the collection and use of your information as described therein.

13. Indemnification

You agree to indemnify and hold harmless TripCabinet, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, misuse of our Services, or violation of any applicable law.

14. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably through negotiation.
If unresolved within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, Karnataka.
These Terms shall be governed by and construed in accordance with the laws of India. The courts of Bangalore, Karnataka shall have exclusive jurisdiction.

15. Modifications to Terms

TripCabinet reserves the right to update or modify these Terms at any time. Changes will be effective upon posting on the Website with an updated "Effective Date". Continued use of our Services after such changes constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
